Acceptable Use Policy

This Acceptable Use Policy outlines the rules and guidelines governing the use of the Central Lense Inc. website, marketplace, and related services. All users must comply with this policy.

1. Purpose

This Acceptable Use Policy ("AUP" or "Policy") governs your use of the Central Lense Inc. website at centrallense.com (the "Website"), including our Microsoft 365 license marketplace, all associated web pages, and any services, tools, or resources made available through the Website (collectively, the "Services"). The purpose of this Policy is to protect the security, integrity, and availability of our Services and to ensure a safe and professional experience for all users. This AUP supplements and is incorporated by reference into our Terms of Use. By accessing or using the Services, you agree to comply with this Policy. Central Lense Inc. reserves the right to modify this AUP at any time. Changes will be effective upon posting to the Website. Your continued use of the Services after any changes constitutes your acceptance of the revised Policy. 2. Prohibited Activities

You agree that you will not engage in any of the following prohibited activities when using the Services: (a) Unauthorized Access and Hacking: Attempting to gain unauthorized access to any part of the Services, other users' accounts, computer systems, or networks connected to the Services through hacking, password mining, brute force attacks, credential stuffing, social engineering, or any other unauthorized means. This includes accessing data not intended for you, logging into a server or account you are not authorized to access, or probing the security of any system or network. (b) Distributing Malware and Malicious Code: Uploading, transmitting, distributing, or otherwise making available any viruses, worms, Trojan horses, ransomware, spyware, adware, keyloggers, rootkits, or other malicious software, code, files, scripts, or programs designed to interrupt, destroy, limit the functionality of, or gain unauthorized access to any computer software, hardware, data, or telecommunications equipment. (c) Data Scraping and Automated Extraction: Using any automated system, including but not limited to robots, spiders, scrapers, crawlers, data mining tools, or any manual process to monitor, extract, copy, scrape, or download data, content, pricing information, product listings, or other material from the Services without our prior written authorization. Standard search engine indexing by recognized search engines is permitted. (d) Sending Spam and Unsolicited Communications: Using the Services to send, facilitate, or support the transmission of unsolicited bulk email, spam, chain letters, phishing messages, pyramid schemes, or any other form of unsolicited or deceptive commercial communications to any person or entity. (e) Intellectual Property Infringement: Using the Services in any manner that infringes, misappropriates, or otherwise violates any intellectual property right of Central Lense Inc. or any third party, including copyrights, trademarks, trade secrets, patents, rights of publicity, or other proprietary rights. This includes unauthorized reproduction, distribution, display, or creation of derivative works. (f) Impersonation: Impersonating or attempting to impersonate Central Lense Inc., any Central Lense employee or representative, another user, Microsoft Corporation, or any other person or entity. This includes creating false identities, using misleading email addresses or headers, or falsely representing your affiliation with any person or entity. (g) Harassment and Threats: Using the Services to harass, threaten, intimidate, stalk, defame, or abuse any individual or group, including Central Lense employees, partners, or other users. This includes the transmission of content that is hateful, threatening, abusive, libelous, or invasive of another person's privacy. (h) Fraudulent Activity: Using the Services in connection with any fraudulent, deceptive, or misleading activity, including but not limited to making purchases with stolen or unauthorized payment methods, engaging in chargeback fraud, submitting false information, or attempting to obtain products or services through deception. (i) Violating Export Controls: Using the Services in violation of any applicable export control laws and regulations, including the U.S. Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR), or any applicable sanctions programs administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC). This includes exporting, re-exporting, or transferring any products, software, or technical data obtained through the Services to prohibited countries, entities, or individuals. (j) Illegal Purposes: Using the Services for any purpose that is unlawful under applicable federal, state, local, or international law, or to promote, facilitate, or encourage any illegal activity. This includes using the Services in connection with money laundering, terrorist financing, or any other criminal enterprise.

3. Network and System Security

You agree that you will not engage in any activity that compromises or threatens the security of the Services, our network infrastructure, or any connected systems. Specifically, you shall not:
  • Probe, scan, or test vulnerabilities of the Services, our network, or any system or network connected to the Services without the prior written authorization of Central Lense Inc. This includes port scanning, vulnerability scanning, penetration testing, and security assessments of any kind.
  • Disrupt or interfere with the Services or the servers, networks, or infrastructure used to provide the Services. This includes denial-of-service (DoS) attacks, distributed denial-of-service (DDoS) attacks, flood attacks, mail bombing, or any other action designed to impair the proper functioning of the Services.
  • Circumvent or attempt to circumvent any security measures, authentication mechanisms, access controls, or usage restrictions implemented on the Services, including rate limiting, IP blocking, CAPTCHA protections, or encryption.
  • Intercept or monitor data or traffic on our network or systems without authorization, including packet sniffing, traffic analysis, or man-in-the-middle attacks.
  • Forge, alter, or manipulate TCP/IP packet headers, email headers, or any part of a message or transmission to disguise the origin of content transmitted through the Services.
  • Exploit any vulnerability in the Services to gain unauthorized access to data, accounts, systems, or networks, whether or not the exploitation causes damage.
Authorized Security Testing: If you wish to conduct security testing of the Services with our permission, you must first obtain written authorization from Central Lense Inc. by contacting [email protected]. Unauthorized security testing will be treated as a violation of this Policy and may be reported to law enforcement.

4. Email and Communications

If you use the Services to send electronic communications, or if you communicate with Central Lense Inc. or other users through the Services, you agree to comply with the following requirements: CAN-SPAM Compliance: All commercial electronic messages sent in connection with the Services must comply with the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 (CAN-SPAM Act), 15 U.S.C. § 7701 et seq., including but not limited to:
  • No deceptive headers: You shall not use false or misleading header information. The "From," "To," "Reply-To," and routing information must accurately identify the person or entity who initiated the message.
  • No deceptive subject lines: You shall not use deceptive subject lines that misrepresent the content of the message.
  • Identification as advertisement: If the message is an advertisement, it must be clearly and conspicuously identified as such.
  • Valid physical address: The message must include the sender's valid physical postal address.
  • Opt-out mechanism: The message must include a clear and conspicuous mechanism for the recipient to opt out of future commercial messages from the sender.
  • Honor unsubscribe requests: You must honor opt-out and unsubscribe requests within ten (10) business days of receipt. You shall not sell, transfer, or share the email addresses of individuals who have opted out.
Additional Requirements: You agree not to use the Services to:
  • Send messages that contain threats, harassment, obscenity, or hate speech
  • Send messages that impersonate Central Lense Inc. or any other person or entity
  • Distribute chain letters, pyramid schemes, or similar communications
  • Collect or harvest email addresses from the Services for the purpose of sending unsolicited communications

5. Compliance with Laws

You agree to use the Services in compliance with all applicable federal, state, local, and international laws, statutes, regulations, and ordinances. Without limiting the generality of the foregoing, you specifically agree to comply with: Federal Laws and Regulations:

  • The Electronic Communications Privacy Act (ECPA), 18 U.S.C. §§ 2510-2522
  • The Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512
  • The CAN-SPAM Act, 15 U.S.C. § 7701 et seq.
  • The Federal Trade Commission Act, 15 U.S.C. §§ 41-58
  • The Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501-6506
Export Controls and Sanctions:
  • The U.S. Export Administration Regulations (EAR), 15 C.F.R. Parts 730-774
  • The International Traffic in Arms Regulations (ITAR), 22 C.F.R. Parts 120-130
  • Sanctions programs administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC)
  • Any other applicable U.S. or international export control or sanctions laws and regulations
You represent and warrant that you are not located in, and are not a national or resident of, any country that is subject to a U.S. Government embargo, and that you are not listed on any U.S. Government list of prohibited or restricted parties, including the Specially Designated Nationals and Blocked Persons List (SDN List) maintained by OFAC. State and Local Laws: You agree to comply with all applicable state and local laws, including data protection and privacy laws such as the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and any other state-level privacy or consumer protection laws that may apply to your use of the Services.

6. Monitoring and Enforcement

Right to Monitor: Central Lense Inc. reserves the right, but does not assume the obligation, to monitor, investigate, and review any activity on the Services to determine compliance with this Policy, our Terms of Use, and applicable law. Monitoring may include reviewing access logs, transaction records, communications, and other information associated with your use of the Services. Investigation: If Central Lense Inc. becomes aware of or reasonably suspects a violation of this Policy, we may, at our sole discretion:
  • Investigate the suspected violation, including gathering information from you and from any other relevant sources
  • Temporarily suspend your access to the Services during the investigation
  • Request that you cease the violating activity immediately
  • Take any technical measures necessary to protect the Services, our network, or other users
Cooperation: You agree to cooperate fully with any investigation by Central Lense Inc. regarding a suspected violation of this Policy. Failure to cooperate may result in additional enforcement action. No Obligation: While Central Lense Inc. may monitor activity on the Services, we are under no obligation to do so. Our decision not to monitor or investigate a particular activity does not constitute approval of or acquiescence to that activity, nor does it waive our right to enforce this Policy at a later time. Reporting to Third Parties: Central Lense Inc. may, at its sole discretion, report suspected violations of law to appropriate law enforcement authorities, regulatory agencies, or affected third parties, and cooperate with such authorities in any investigation.

7. Consequences of Violation

Violation of this Acceptable Use Policy may result in one or more of the following actions, at the sole discretion of Central Lense Inc., depending on the nature and severity of the violation:
  1. Warning: For minor or first-time violations, we may issue a written warning via email notifying you of the violation and requesting that you cease the offending activity immediately. Warnings are documented and may be considered in connection with any future violations.
  2. Suspension: We may temporarily suspend your access to all or any part of the Services, including the Marketplace, pending investigation or resolution of the violation. During suspension, you may not be able to access your account, place orders, or use any functionality of the Services.
  3. Termination: We may permanently terminate your access to the Services, including the Marketplace and all associated accounts, without prior notice and without refund. Termination may be immediate for severe violations, including but not limited to unauthorized access, distribution of malware, fraud, or illegal activity.
  4. Legal Action: Central Lense Inc. reserves the right to pursue any available legal remedies, including civil litigation for damages, injunctive relief, and recovery of attorneys' fees and costs, against any individual or entity that violates this Policy.
  5. Reporting to Law Enforcement: We may report violations of this Policy that constitute or may constitute criminal activity to appropriate federal, state, or local law enforcement authorities, and we will cooperate fully with any resulting investigation or prosecution.
The remedies set forth above are cumulative and are not exclusive of any other remedies available to Central Lense Inc. under law or equity. Our decision to pursue one remedy does not waive our right to pursue any other remedy. Central Lense Inc. shall not be liable to you or any third party for any suspension or termination of access resulting from a violation of this Policy.

8. Reporting Violations

If you become aware of any activity that you believe violates this Acceptable Use Policy, we encourage you to report it promptly. Your reports help us maintain the security and integrity of our Services for all users.   • A description of the activity you believe violates this Policy
  • The date and time the activity occurred or was observed
  • Any relevant URLs, email addresses, usernames, or other identifying information

  • Your contact information so we can follow up if needed
Good Faith Reporting: Reports made in good faith will not result in any adverse action against the reporter. Central Lense Inc. will treat all reports confidentially to the extent practicable, consistent with our obligation to investigate and, where appropriate, report violations to law enforcement. We appreciate your help in keeping our Services safe, secure, and compliant.
